Commentary
آیت 68 لَوْلاَ کِتٰبٌ مِّنَ اللّٰہِ سَبَقَ لَمَسَّکُمْ فِیْمَآ اَخَذْتُمْ عَذَابٌ عَظِیْمٌ ۔اس سے مراد سورة محمد ﷺ کا وہ حکم ہے آیت 4 جو بہت پہلے نازل ہوچکا تھا۔ اس کی تفصیل ہم ان شاء اللہ سورة محمد ﷺ کے مطالعے کے دوران پڑھیں گے کہ رسول اللہ ﷺ نے اس حکم کی تعبیر interpretation میں کس طرح فدیہ لینے کی گنجائش نکالی تھی۔ یہ دراصل قانون کی تشریح و تعبیر کا معاملہ ہے۔ جیسا کہ سورة الزمر کی آیت 18 میں ارشاد ہے : الَّذِیْنَ یَسْتَمِعُوْنَ الْقَوْلَ فَیَتَّبِعُوْنَ اَحْسَنَہٗ ط یعنی وہ لوگ جو کسی بات کو سن کر پیروی کرتے ہیں اس میں سے بہترین کی اور اس کے اعلیٰ ترین درجہ تک پہنچنے کی کوشش کرتے ہیں۔ چناچہ اس قانون کی تعبیر میں بھی ایسے ہی ہوا۔ چونکہ مذکورہ حکم کے اندر یہ گنجائش یا رعایت موجود تھی اس لیے حضور ﷺ نے اپنی طبیعت کی نرمی کے سبب اس کو اختیار فرما لیا۔ آیت زیر نظر کے اندر سے بھی یہی اشارہ ملتا ہے کہ سورة محمد ﷺ میں نازل شدہ حکم میں رعایت کی یہ گنجائش موجود تھی ‘ اسی لیے تو اس حکم کا حوالہ دے کر فرمایا گیا کہ اگر وہ حکم پہلے نازل نہ ہوچکا ہوتا تو جو بھی تم نے فدیہ وغیرہ لیا ہے اس کے باعث تم پر بڑا عذاب آتا۔ روایات میں آتا ہے کہ حضور ﷺ اور حضرت ابوبکر رض اس آیت کے نزول کے بعد روتے رہے ہیں۔ بہر حال اس فیصلے میں کسی صریح حکم کی خلاف ورزی نہیں تھی اور جو بھی رائے اختیار کی گئی تھی وہ اجتہادی تھی اور آپ ﷺ نے اجتہاد کے ذریعے اس حکم میں سے نرمی اور رعایت کا ایک پہلو اختیار کرلیا تھا۔
