- یُؤْذُوْنَجو ایذا دیتے ہیں

ور جو لوگ مومن مردوں اور عورتوں کو بے قصور اذیت دیتے ہیں اُنہوں نے ایک بڑے بہتان1 اور صریح گناہ کا وبال اپنے سر لے لیا ہے

یہ آیت بہتان کی تعریف متعین کر دیتی ہے ، یعنی جو عیب آدمی میں نہ ہو، یا جو قصور آدمی نے نہ کیا ہو وہ اس کی طرف منسوب کرنا۔ نبی صلی اللہ علیہ و سلم نے بھی اس کی تصریح فرمائی ہے۔ ابو داؤد اور ترمذی کی روایت ہے کہ حضورؐ سے پوچھا گیا غیبت کیا ہے ؟ فرمایا ذکرک اخاک بمَا یکرہ ۔’’ تیرا اپنے بھائی کا ذکر اس طرح کرنا جو اس ناگوار ہو۔‘‘ عرض کیا گیا اور اگر میرے بھائی میں وہ عیب موجود ہو۔ فرمایا ان کان فیہ ما تقول فقد اغتبتہٗ وان لم یکن فیہ ما تقول فقد بھتّہ۔’’ اگر اس میں وہ عیب موجود ہے جو تُو نے بیان کیا تو تُو نے اس کی غیبت کی۔ اور اگر وہ اس میں نہیں ہے تو تُو نے اس پر بہتان لگایا۔‘‘ یہ فعل صرف ایک اخلاقی گناہ ہی نہیں ہے جس کی سزا آخرت میں ملنے والی ہو۔ بلکہ اس آیت کا تقاضا یہ ہے کہ اسلامی ریاست کے قانون میں بھی جھوٹے الزامات لگانے یو جرم مستلزمِ سزا قرار دیا جائے۔

Commentary
آیت 58{ وَالَّذِیْنَ یُؤْذُوْنَ الْمُؤْمِنِیْنَ وَالْمُؤْمِنٰتِ بِغَیْرِ مَا اکْتَسَبُوْا } ”اور وہ لوگ جو ایذا پہنچاتے ہیں مومن مردوں اور مومن عورتوں کو بغیر اس کے کہ انہوں نے کسی گناہ کا ارتکاب کیا ہو“ ان پر بےجا الزام لگاتے ہیں ‘ بہتان تراشی کرتے ہیں اور اس طرح کے دوسرے حربوں سے انہیں اذیت پہنچاتے ہیں۔ { فَقَدِ احْتَمَلُوْا بُہْتَانًا وَّاِثْمًا مُّبِیْنًا } ”تو انہوں نے اپنے سر بہتان اور صریح گناہ کا بوجھ لے لیا ہے۔“ واضح رہے کہ اس آیت کے نزول تک ”قذف“ زنا سے متعلق جھوٹی تہمت لگانا کی سزا کا حکم نازل نہیں ہوا تھا۔ اس لیے یہاں صرف اس جرم کی سنگینی کی طرف اشارہ کیا گیا ہے ‘ البتہ سورة النور کی آیت 4 میں قذف کی حد 80 کوڑے مقرر کی گئی ہے۔ یعنی اگر کوئی شخص کسی مسلمان خاتون پر زنا کا الزام لگائے اور اس پر موقع کے چار گواہ پیش نہ کرسکے تو اس کو سزا کے طور پر 80 کوڑے لگائے جائیں گے۔
